Biography
Brian Melton is a skilled attorney practicing primarily in the areas of corporate law, mergers and acquisitions, asset purchases and sales, transactional law, commercial litigation, contract disputes, general negligence, fraud, breaches of member/shareholder duties, business torts, and alternative dispute resolution (mediation and/or arbitration). Notwithstanding those primary practice areas, he mostly represents small and midsize business owners, whose needs often exceed those boundaries and require an individualized approach for a successful resolution. Clients will benefit from Brian’s expansive view of the law; whereas that type of broad perspective is often unavailable from practitioners who focus only on one or two areas of the law. Indeed, Brian’s clients often enjoy the benefit of his broad capacity for proposing creative solutions and plans of action.
Whether you are an individual, a small business owner, or just one of many shareholders in a company, Brian understands that your case or issue is unique and deserves an approach that is tailored to your individual needs and concerns. Perhaps most importantly, Brian understands that meaningful attempts at compromise – even when the attempts are uncomfortable – almost always yield better, less expensive results than a judicially determined outcome. For that very reason, Brian will make a concentrated effort to handle your case with the goal of finding the most direct and efficient path to success.
Brian is currently licensed and admitted to practice in the State and Federal Courts of Colorado, and has also previously held a license to practice in the State and Federal Courts of Oklahoma. Brian is a member of the El Paso County and Colorado Bar Associations, and is honored to have been nominated to the American Institute of Trial Lawyers and National Trial Lawyers Top 40 Under 40 Lists, as well as the Super Lawyers Rising Stars List.
During his time in practice, Brian has represented hundreds of clients in a large variety of disputes including breaches of contract, intentional interference with contracts and/or business relations, employment law, business entity formation, breaches of fiduciary duty, negligence, insurance bad faith, criminal charges, fraud, defamation, intentional torts such as assault and battery, and personal injury. Brian is fortunate to have represented clients in a variety of venues and jurisdictions ranging from County Court and District Court litigation all the way up to appellate and State Supreme Courts, including seeking extraordinary relief such as writs of mandamus. This breadth of experience will benefit a wide range of clients, especially those with multifaceted issues.
Brian was active in moot court during law school, representing the University of Tulsa in the National Health Law Moot Court Competition and the American Association of Justice Mock Trial Competition, participating in numerous interscholastic competitions, and winning the Criminal Motions Hearing Competition. This demonstration of excellence and high honor in the art of courtroom advocacy resulted in admission to the Order of Barristers.
